    JOBCAM Privacy Policy

    Thanks for using JobCam, and thanks for reading this Privacy Policy. This policy explains what personal information we collect when you use the JobCam service, how we use and store it, who we share it with, and the choices and rights you have. It is written to comply with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

    The JobCam service is provided by JobCam Pty Ltd (ABN 98 661 836 264), referred to in this policy as "the Provider" (also "we", "us" and "our"). The JobCam camera platform is operated on JobCam's behalf by Security Queensland Pty Ltd (registered number 99639409868) of 22/37 Mortimer Road, Acacia Ridge, QLD, 4110, Australia, referred to as "the platform operator", using technology supplied by our third-party cloud video platform provider.

    What information we collect

    When the Provider creates a JobCam account for you, we may collect and hold the following personal information:

    • Account details — your name, email address and company name (where applicable).
    • Camera footage — the video your cameras record while connected to the service.
    • Analytics data — if you enable Analytics, the service scans your footage for objects and text. Detected objects may include (without limitation) vehicles, people, machinery and clothing, and any text in the camera's field of view, which may include vehicle signage and number plates. Object labels and recognised text are stored for the same period as the related video and are deleted on the same schedule.
    • Usage and device information — device and app settings, the names of your devices (so we can show you a meaningful list of cameras), and how you use the service. We also use IP addresses to identify the general location of users, to block disruptive use and to understand overall usage.

    We do not collect or have access to payment card details. You pay your subscription directly to the Provider, and your payment relationship is with the Provider only.

    How we use your information

    We use your personal information to:

    • provide the service and respond to your requests and enquiries;
    • carry out service administration — for example, password reminders or notices that a feature will be unavailable for maintenance;
    • tell you about the services, products and activities we offer;
    • personalise how the service is presented to you; and
    • analyse and improve the service.

    We will only view your footage (1) with your express permission, for example to resolve a technical problem you have raised, or (2) where disclosure is required or permitted by law as set out below.

    Where your footage and data are stored

    Your camera footage is stored in the cloud on Amazon Web Services (AWS) infrastructure operated by our cloud video platform provider. This footage is currently stored in AWS data centres located in the United States. This means your personal information, including your footage, is stored and processed overseas.

    Under Australian Privacy Principle 8 we are required to tell you when your personal information may be disclosed to recipients overseas. By using the service you acknowledge that your footage and associated data are stored outside Australia, and that overseas storage necessarily involves the laws and legal authorities of the country where the data is held. We take reasonable steps to ensure your information is handled consistently with the APPs.

    A short-term upload buffer is held on the camera itself only until footage has been uploaded to the cloud. Footage is not retained long-term on the camera.

    Some usage data (not footage), such as which features you use in the app, is collected and stored in Google Firebase to help us understand overall usage and improve the service. It is not used to analyse your individual activity unless you ask us to investigate a problem you have experienced.

    Who we share your information with

    We share your information only as needed to provide the service you have requested:

    • with the platform operator and our cloud video platform provider, who host and operate the camera platform on our behalf;
    • with our advisers, suppliers and partners where necessary to deliver the service; and
    • where disclosure is required or permitted by law, where you have given consent, where it is necessary to protect the legal rights, property or safety of the Provider, a customer or a third party, or in connection with a sale, merger or transfer of our business.

    We do not sell your personal information, and we do not share it with third parties for purposes other than providing the service you have requested.

    How long we keep your information

    Your footage is retained according to your cloud storage plan (typically between 30 and 90 days) and is then automatically deleted. Once footage has been deleted it cannot be recovered, as no additional back-ups are kept. We keep other personal information only for as long as it is needed for the purposes described in this policy, or as required by law.

    Keeping your information secure

    We take reasonable steps to protect your personal information from misuse, interference, loss and unauthorised access, modification or disclosure. Footage is encrypted while being transmitted to, and while stored in, the cloud. The short-term upload buffer held on the camera is not encrypted.

    If we become aware of a data breach that is likely to result in serious harm, we will assess it and notify affected individuals and the Office of the Australian Information Commissioner (OAIC) as required under the Notifiable Data Breaches scheme.

    Accessing and correcting your information

    You have the right to ask for access to the personal information we hold about you, and to ask us to correct it if it is inaccurate. You can view and download your footage, and see your device names and clip titles and descriptions, directly in the app at any time. For any other personal information, please contact the Provider using the details below, and we will respond within a reasonable period.

    Deleting your data and closing your account

    Please contact the Provider if you wish to close your JobCam account. When your account is closed, your email address is removed promptly and all of your footage is deleted, after which it cannot be recovered.

    Making a complaint

    If you have a complaint about how your personal information has been handled, please raise it with the Provider (JobCam Pty Ltd) in the first instance. If you remain dissatisfied, you can lodge a complaint with the Office of the Australian Information Commissioner (OAIC) — visit www.oaic.gov.au or call 1300 363 992.
